(1) Whenever the Secretary of Justice receives information that, in his judgment, constitutes sufficient cause to investigate whether any official, former official, employee, former employee or individual not listed in § 99k of this title has committed any of the crimes referred to in § 99k of this title, he may carry out a preliminary investigation at his discretion, and request the appointment of a Special Prosecutor whenever he determines that if the investigation is carried out by the Secretary of Justice, it may result in a conflict of interest.(2) Whenever the Secretary determines that there is no conflict of interest whatsoever that may hinder an objective investigation by the Department of Justice, the Secretary shall designate the official who shall conduct the investigation, and the Department of Justice shall assume its jurisdiction.
