(a) Procedure. —\n(1) Any business wishing to be registered as a small or a medium-size business shall apply to the Company, following the regulations which said agency shall provide for this purpose.\n(2) As part of the application submitted to the Company, the business shall document its product or service, its place of operations, the number of employees, its gross sales and its responsibilities as established by law or regulations.\n(3) Upon the approval of the application by the Company, the latter shall remit the letter of approval to the business and include the same in the register of authorized small and medium-size businesses. The Company shall advise the small and medium-size merchant that it is mandatory to register with the ERB of the Administration so as to able to participate in the procurement process, save for the exceptions provided through regulations.\n(b) Time. —\n(1) A business may at any time request to be classified as [a] small or medium-size business and be included in the Register of Small and Medium-size Businesses.\n(2) In order for a contract to be adjudicated under the Reserve Program, the small or medium-size business must be eligible and certified
