When the owner of an estate changes the outlet of water brought to the surface in accordance with the provisions of §§ 21 and 68 of this Act and thereby causes damage to a third person, the latter may demand damages. The diversion or suppression of the use of surplus water by those who enjoy the same only temporarily shall not be considered damage. History —Law of Waters, art. 73.
