When irrigated land which receives water from a single point is divided by inheritance, sale, or other title, between two or more persons the owners of the higher portion shall be obliged to give passage to the water as an aqueduct servitude for the irrigation of the lower sections, and cannot demand any compensation therefor in the absence of an agreement to the contrary.
