The cost of all works necessary for the construction, maintenance, and cleaning of the aqueduct shall be defrayed by the person who sought and obtained the servitude. To this end he shall be authorized to occupy temporarily the land necessary for the deposit of material, after payment for losses and damages or furnishing bond sufficient if the damages cannot be easily estimated, or if the persons interested should not agree thereto. The latter or the administration may compel him to construct the work and ditches necessary to prevent stagnation or seepage of water which might cause damage. History —Law of Waters, art. 90.
