(a) The provisions of this chapter relating to permits and franchises shall not apply to 'surfacing' resulting from activities carried out for other purposes. The Secretary shall provide by regulation the procedure to be followed in such cases.(b) Waters 'surfaced' in violation of this chapter shall not legally benefit the person who 'surfaced' them.
