(a) Cigarettes that are certified by the manufacturer in accordance with § 342b of this title shall be marked to indicate compliance with the requirements of § 342a of this title. The marking shall be in 8 point type or larger, and shall consist of the letters 'FSC' (Fire Standard Compliant), which shall be printed, stamped, engraved, or embossed on the package near the UPC, or(b) Manufacturers may only use one marking and shall apply this marking uniformly for all packages, including, but not limited to packs, cartons, cases, and brands marketed by that manufacturer.(c) Manufacturers certifying cigarettes in accordance with § 342b of this title shall provide a copy of the certifications to the Fire Chief. Wholesale dealers, agents, and retail dealers shall allow the Fire Chief, the Secretary of the Department of the Treasury, the Secretary of the Department of Justice, and their respective employees to inspect markings of cigarette packaging marked in accordance with this chapter.
