When compensation has been paid for damages or death pursuant to the provisions of this chapter, the Fund, represented by the Secretary, shall be entitled to compensation by the person responsible for the injury or death, in a sum equal to that disbursed as compensation, in addition to the expenses incurred for costs. In the cases in which the victim or dependent files a suit against the person responsible for the injury or death, and an indemnification is granted, the court shall order the payment to be made separately in favor of the Fund and the claimants for the amount corresponding to each.
