When a person charged with committing a felony refuses to be fingerprinted or photographed, or fails to, or refuses to appear for such purpose, the Police Superintendent, the Director of the Special Investigations Bureau of the Department of Justice, or their authorized agent, or any person empowered by law to such effects, may petition the Court of First Instance for assistance to require said person to allow himself to be fingerprinted or photographed, or to appear for such purpose. After filing the petition before the Court of First Instance, [the court] shall issue a summons directing the person to allow his fingerprints or photograph to be taken, or to appear for such purpose.
