(a) The officers and men enlisted in the Military Forces of Puerto Rico shall be discharged in accordance with this part, the regulations or prescriptions provided by the Bureau of the National Guard of the United States of America or by the Commander-in-Chief. In times of peace, licenses may be granted prior to the expiration of the enlistment period, pursuant to the rules and regulations that the Commander-in-Chief may prescribe, subject to the restrictions imposed to such effects by the laws or regulations in force promulgated by the Congress or the President of the United States.\n(b) The Adjutant General may, acting in behalf of the Commander-in-Chief, investigate, through an investigating officer appointed for the purpose, the moral conduct, ability and general fitness for the service or office held by any enlisted member of the Military Forces of Puerto Rico. If from the report of the investigating officer the Adjutant General determines that the moral conduct, ability and general fitness for the service or office held by said enlisted member affects, is contrary to, or constitutes a risk to the good name, interest or discipline of the Military Forces of Puerto Rico or the
