If the Secretary does not issue a decision on the petition to obtain a certificate of necessity and convenience or on the petition for exemption, during the period of time established in § 334f-8 of this title, the petitioner may resort to the corresponding Part of the Court of First Instance for it to direct the Secretary to issue his decision.
