Any person who directly or indirectly throws, discharges, pours or dumps, and/or causes or allows to be thrown, discharged, poured, or dumped, into any waters, organic matter capable of polluting or leading to the pollution of said waters, after having received a final order to the effect that he shall cease to do it, as established in § 596 of this title, or who violates any of the provisions of this chapter or its regulations, shall, upon conviction, be punished for each violation by a fine of not less than one hundred dollars ($100) nor more than one thousand dollars ($1,000), or by imprisonment in jail for a term of not less than ninety (90) days nor more than one year, or by both penalties; Provided, That each day such violation continues to exist or in which a final order is not complied with, shall constitute a distinct and separate violation; and, Provided further, That injunction shall lie against any person who violates the provisions of this chapter or regulations hereunder whenever, in the judgment of the Secretary, the seriousness of the case may so warrant.
