Any person violating § 821 of this title shall be guilty of a misdemeanor and, upon conviction, shall be sentenced, for the first violation, to pay a fine of not less than twenty-five dollars ($25) nor more than one hundred dollars ($100), and for subsequent violations, to pay a fine of three hundred dollars ($300) and to be confined in jail for a term of from one (1) to three (3) months; Provided, That if said person commits such violation while, and because of, carrying on the business of selling roasted or ground coffee, a subsequent offense shall carry with it, in his case, the definite revocation of the license granted him; and, Provided, further, That no person shall be granted a license to carry on such business if he has violated in any way said § 821 of this title.
