It is presumed that all persons are mentally competent, except otherwise determined by a court. The judicial determination of disability under § 2342 of Title 31, shall be distinct and separate from the judicial proceeding to determine if an adult should be subject to involuntary admission.It shall be presumed that any person with a mental or emotional disorders has the potential to recover and rehabilitate upon receiving mental health services adequate to his/her diagnosis and the severity of his/her symptoms and signs.
