Any institutional mental healthcare provider facility which is found to have institutionalized a person, whether an adult or a minor, who does not meet the clinical criteria nor present the severity that warrants his/her placement at the level of care where he/she has been kept, after symptoms and signs have been stabilized for the level of care in which he/she remained, thus being deprived from a greater autonomy, less intensive and less restrictive level of care, shall be guilty of a crime, as provided for in § 4796 of Title 33.
