(a) Any person practicing the profession of psychoactive substance use prevention specialist or assistant in Puerto Rico, or who advertises as such without having a certification duly issued by the Evaluating Commission for Psychoactive Substance Use Prevention Specialist Certification, or who during the suspension of his/her certification practices as a person authorized to practice, shall be guilty of a misdemeanor and upon conviction be imposed a fine not greater than five thousand dollars ($5,000) or imprisonment for a term not to exceed six (6) months, or both penalties, at the discretion of the court.(b) Any person who deliberately provides false information in order to obtain a psychoactive substance use prevention specialist certification under this chapter shall be guilty of a misdemeanor and his/her conviction shall entail a fine not greater than five thousand dollars ($5,000) or imprisonment for a term not to exceed six (6) months, or both penalties, at the discretion of the court.
