Any contractor who starts a work, building or construction without having posted the bond required by this chapter in behalf of the Secretary of Labor and Human Resources shall be guilty of a felony and upon conviction shall be punished by a fine of not less than one thousand dollars ($1,000) nor more than five thousand dollars ($5,000), or by imprisonment in jail for a term of not less than one month nor more than one year, or both penalties in the discretion of the court.
