Any natural or juridical person who is subject to the provisions of the preceding § 1020b of this title, and does not comply with the provisions of §§ 1020a—1020f of this title, shall incur a misdemeanor and upon conviction thereof, shall be punished with a fine that shall not exceed five hundred dollars ($500), or the penalty of restitution, or both penalties, at the discretion of the court. The Secretary of the Department of Consumer Affairs may opt to impose an administrative fine in lieu of filing a criminal complaint, in which case the fine shall not exceed five thousand dollars ($5,000) for each day that a violation of §§ 1020a—1020f of this title is incurred.
