The Board may refuse to renew, or revoke, or temporarily or permanently suspend a license issued pursuant to the provisions of this chapter after notifying the interested party and giving him the opportunity to be heard, when:\n(a) He has been convicted of a felony or misdemeanor that implies moral depravity.\n(b) Has obtained, or tried to obtain, a license to practice the profession of respiratory care technician through fraud or deceit.\n(c) Has incurred, or allows a person with a provisional license who works under his responsibility and supervision to incur in gross negligence in the practice of his professional duties in detriment of a third party.\n(d) Has been declared mentally unfit by a competent court or his unfitness has been established before the Board through medical expertise; Provided, That it can be restored as soon as the person is again declared fit, if he meets the other requirements provided by this chapter.\n(e) Is addicted to drugs or alcohol; Provided, That it can be granted or restored once he is fit, if he meets the requirements provided by this chapter.\nHistory —June 4, 1987, No. 24, p. 69, § 20.
