(a) Pursuant to chapter 13.1 of this title, the director, or the director’s designee, may conduct investigations as he or she deems necessary in order to ascertain whether any person has violated or is violating any provision of this chapter. (b) Whenever the director, or the director’s designee, has reason to believe that a provision of this chapter has been violated, he or she may report the violation of law to the attorney general who may bring an action in the court of appropriate jurisdiction. Within one hundred twenty (120) days of receipt of the director’s report, the attorney general shall inform the director, or the director’s designee, as to the status of the reported violations. Where the affected insurer has become the subject of a court order for conservation, rehabilitation, or liquidation, the director, or the director’s designee may also refer the matter to the receiver for action under § 27-54-2.
