§ 42-64-9-9

Any permit, permit application, or effluent data shall be available to the public for inspection and copying in accordance with chapter 2 of title 38 ('Access to Public Records'). Confidential or privileged materials may be disclosed or transmitted to other officers, employees, or agents of the corporation.
