§ 49-4-180

(A) A surface water withdrawer who commits a violation of this chapter: (1) is subject to a civil penalty of not more than ten thousand dollars for each day that the violation occurred; or (2) is guilty of a misdemeanor and, upon conviction, must be fined not more than ten thousand dollars for each day that the violation occurred, if the violation is wilful. (B) All penalties and fines assessed and collected pursuant to this chapter must be deposited in the general fund of the State. Effect of Amendment The 2010 amendment rewrote the section.
