(A) It is unlawful for a person whose commercial privileges are suspended under this chapter: (1) to take or attempt to take saltwater fish for commercial purposes; or (2) to be on board any vessel while the vessel is being utilized to take or in an attempt to take saltwater fish for commercial purposes. A person who violates this subsection is guilty of a misdemeanor and, upon conviction, must be fined five thousand dollars or imprisoned for not more than thirty days, and all saltwater privileges must be suspended for an additional period of five years. (B) No person for whom a saltwater privilege is suspended may purchase or acquire, or attempt to purchase or acquire, a license, permit, or stamp for any privilege which has been suspended. A person who violates this subsection is guilty of a misdemeanor and, upon conviction, must be fined not less than two hundred dollars nor more than five hundred dollars or imprisoned for not more than thirty days and by extension of the suspension period for twelve months. (C) No court may suspend any portion of the minimum fines or lengths of imprisonment provided in this section. HISTORY: 2000 Act No. 245, Section 13.
