Unless waived as provided in Section 58-15-2120, the provisions of Sections 58-15-2110 to 58-15-2130 shall not affect or in anywise relieve any railroad company or operator of any penalties incurred under Sections 58-15-2110 to 58-15-2130 or former Sections 58-15-2110 to 58-15-2130.
