§ 11-3-12-2

11-3-12.2. Promulgation of rules for approval of access to state highways.The Transportation Commission may adopt rules, pursuant to chapter 1-26, governing the following elements in granting written approval for access to state highways as provided for in §§11-3-12.1 and 31-24-6:(1)Access location, width, and spacing;(2)Signal spacing;(3)Median design;(4)Access application process;(5)Access construction standards; and(6)Safety.Nothing in the rules promulgated pursuant to this section supersedes county or municipal planning and zoning authority.
