Section 21-32-11 - Undertaking for costs filed by plaintiff in Supreme Court action

Undertaking for costs filed by plaintiff in Supreme Court action.At the time a complaint is filed pursuant to §21-32-10, the plaintiff shall file an undertaking in the penal sum of five hundred dollars, with two or more sureties, to be approved by the state treasurer, to the effect that he will indemnify the state against all costs that may accrue in such action, and pay to the clerk of the Supreme Court all costs in case he shall fail to prosecute his action, or to obtain a judgment against the state; and thereupon the action shall be placed upon the calendar of said court.
