23A-27-39. Discharge of guilty but mentally ill defendant by treating facility--Report.If a treating facility discharges a defendant pursuant to §23A-27-38 prior to the expiration of his sentence, the facility shall forward to the Board of Pardons and Paroles a report on the condition of the defendant. The report shall contain the clinical facts, the diagnosis, the course of treatment, and the prognosis for remission of symptoms. Source: SL 1983, ch 174, §19.
