Publicly owned and operated nursing facility may receive and shall remit payments under §§28-6-30 and 28-6-31--Exception.Notwithstanding any other provision of law governing the operation of a publicly owned and operated nursing facility, a publicly owned and operated nursing facility participating under the provisions of §§28-6-28 to 28-6-36, inclusive, may receive and immediately upon receipt shall remit payments provided under §§28-6-30 and 28-6-31. No payment is required under this section for any period in which the use of funds for the purposes of §§28-6-28 to 28-6-36, inclusive, are prohibited due to action by the secretary of the United States Department of Health and Human Services.
