34A-1-2. Definition of terms.Terms used in this chapter mean:(1)'Air contaminant,' dust, fumes, mist, smoke, other particulate matter, vapor, gas, odorous substances, radioactive materials as defined in chapter 34-21, or any combination thereof;(2)'Air pollution,' the presence in the outdoor atmosphere of one or more air contaminants in such quantities and duration as is or tend to be injurious to human health or welfare, animals or plant life, or property, or would interfere with the enjoyment of life or property;(3)'Board,' the Board of Minerals and Environment;(4)'Department,' the Department of Agriculture and Natural Resources;(5)'Emission,' a release into the outdoor atmosphere of air contaminants;(6)'Person,' any individual, partnership, limited liability company, firm, association, municipality, public or private corporation, subdivision or agency of the state, trust, estate, or any other legal entity;(7)'Secretary,' the secretary of agriculture and natural resources.
