34A-11-13. Application for permits--Rules--Hearings.The Board of Minerals and Environment may promulgate rules, pursuant to chapter 1-26, governing the application for permits to own, construct, modify, or operate a hazardous waste treatment, storage, or disposal facility. The rules may require the submission of plans, specifications, and other information as may be necessary to execute the provisions of this chapter. The board may promulgate rules allowing the issuance or denial of a permit by the Department of Agriculture and Natural Resources following notice and opportunity for a hearing before the board on the department's proposed decision.
