Abatement of proceedings when condemnation judgment excessive--Payment of costs.If upon condemnation proceedings, a judgment is entered that will cause the limitation in §41-18-12 to be exceeded on a particular park or project, or if the board of county commissioners deems the judgement excessive, the costs of the proceeding including a reasonable attorney's fee for the owner, to be fixed by the court, shall be taxed to and paid by the county and the proceedings shall be abated and the judgment canceled.
