46A-1-83.2. Expenditure of fees deposited in environment and water resources trust fund--Access to fund--Appropriation.The secretary may expend such sums as are deposited in the South Dakota environment and water resources trust fund pursuant to §34A-6-1.17 by any large-scale solid waste disposal facility subject to the fee established in §34A-6-1.17 as are necessary to conduct the inspections and other activities required under §34A-6-57. The secretary's access to these funds does not require application or grant from the Board of Water and Natural Resources.
