50-13-16. Reckless operation of aircraft--Violation as misdemeanor--Considerations.It is a Class 1 misdemeanor for any person to operate an aircraft in the air or on the ground or water in a careless or reckless manner so as to endanger or be likely to endanger any person or property. In any proceeding for a violation of this section, the court in determining whether the operation was careless or reckless shall consider the standards for safe operation of aircraft prescribed by federal statutes, regulations, or advisories governing aeronautics.
