Section 29-37-106 - Bad faith or frivolous claims

If the court finds that the small business' claim for fees and other expenses under this chapter was made in bad faith or was frivolous or was made for the sole basis of harassment, the court may impose a fine on the small business of not more than two thousand dollars ($2,000) which will go to the state agency or local government involved in the action.Acts 1984, ch. 495, § 6; 1989, ch. 365, § 13.
