Section 35-9-103 - Applicability of Sections 35-9-101 and 35-9-102

Sections 35-9-101 and 35-9-102 do not apply to any trust to the extent that a court of competent jurisdiction determines that the application would be contrary to the terms of the instrument governing the trust and that the same may not properly be changed to conform to those sections.Acts 1971, ch. 3, § 3; T.C.A., § 35-1003.
