Section 40-20-102 - Discretion as to fine or imprisonment

In all prosecutions for misdemeanors where the punishment prescribed is a fine or imprisonment, or both, the discretion as to the punishment shall be in the court unless otherwise provided.Code 1932, § 10757; T.C.A. (orig. ed.), § 40-2702.
