An offender convicted of any of the following offenses is ineligible to participate in the special alternative incarceration program:(1) Class A felony;(2) Aggravated robbery;(3) An offense involving sexual contact or sexual penetration, as defined in § 39-13-501;(4) An offense involving child abuse, child sexual abuse, or sexual exploitation of a minor;(5) An offense involving the illegal distribution or sale of a controlled substance or controlled substance analogue to a minor;(6) An offense involving serious bodily injury, as defined in § 39-11-106; or(7) An offense involving death to a victim or bystander.Acts 1989, ch. 217, § 6; 1992, ch. 838, § 4; 2012, ch. 848, § 32.
