Section 45-7-143 - Orders

If, after notice and an opportunity for a hearing, the commissioner finds that a person has violated this chapter or a rule promulgated in accordance with this chapter, the commissioner may order the person to:(1) Cease and desist violating the chapter or any rule promulgated in accordance with this chapter;(2) Refund, disburse, or disgorge any fees collected in violation of this chapter or a rule promulgated in accordance with this chapter;(3) Pay to the commissioner a civil penalty in an amount specified by the commissioner, not to exceed one thousand dollars ($1,000) for each violation or, in the case of a continuing violation, one thousand dollars ($1,000) for each day that the violation continues; or(4) Pay the costs and expenses for the investigation and prosecution of the matter, including reasonable attorney's fees.Added by 2023 Tenn.
