(a) This chapter applies to all cemeteries, community and public mausoleums, whether operated for profit or not for profit, within this state, except cemeteries exempt under § 46-1-106. Cemeteries existing on or after January 1, 2007, shall be operated in accordance with this chapter and chapter 2 of this title, which together shall be known and may be cited as the 'Cemetery Act of 2006.'
