Section 49-1-203 - Waiver of state board rules

(a) The commissioner of education is authorized to grant waivers to a school that does not comply with the rules and regulations of the state board of education only when officially requested by action of the local board of education.(b) Waivers may be granted for no more than two (2) years in succession for the same violation in the same school. The waiver may be extended for an additional period by the commissioner if, in the commissioner's judgment, additional time is required by the local board of education to secure the necessary funding for the removal of the condition that necessitated the waiver.(c) The department shall include on its website: (1) Any rules, regulations or policies of the state board that are waived by the local board of education within five (5) business days of the commissioner's approval; and(2) An explanation from the local board of education for the waiver.Amended by 2014 Tenn.
