Section 49-6-4214 - Nonpublic schools - Resource officers - Compliance - Contract stipulations

(a) Notwithstanding another law to the contrary, a county or municipality may enter into a contract or memorandum of understanding with a nonpublic school authorizing the county's or municipality's law enforcement agency to provide school resource officers to the nonpublic school.(b) A school resource officer assigned to a nonpublic school must comply with the employment standards for school resource officers outlined in § 49-6-4217.(c) A contract or memorandum of understanding may stipulate:(1) The duties and responsibilities of the parties;(2) The burden of liability that arises from negligence or gross negligence by any party. A county or municipality may waive sovereign immunity for one (1) or more law enforcement officers for purposes of executing a contract or memorandum of understanding under this section;(3) The length of the contract or memorandum of understanding;(4) Salary, benefits, and schedule; and(5) Any other provisions that the parties to the contract or memorandum of understanding deem necessary to effectuate the contract or memorandum of understanding.Added by 2023 Tenn.
