Section 52-3-104 - Confidential information - Persons authorized to disclose

Information about a person supported that is confidential under § 52-3-103 may be disclosed with the consent of:(1) The person supported who is sixteen (16) years of age or older;(2) The conservator of the person supported or a conservator whom the court has granted the authority to make such disclosures;(3) The attorney in fact under a power of attorney who has the right to make disclosures under the power;(4) The parent, legal guardian, or legal custodian of a person supported who is a child;(5) The person supported's guardian ad litem for the purposes of the litigation in which the guardian ad litem serves;(6) The executor or administrator of the estate of a deceased adult person supported, or the parent or legal guardian of a deceased person supported who was a minor at the time of death;(7) The caregiver under title 34, chapter 6, part 3; or(8) An individual acting as an agent, or a person's surrogate as designated, under the Tennessee Health Care Decisions Act, compiled in title 68, chapter 11, part 18.Added by 2024 Tenn.
