Section 55-21-207 - Commissioner's authority to investigate and assess penalty

The commissioner, or the director if authority has been delegated by the commissioner, may upon the person's own initiative, and shall, upon the verified complaint of any person or public agency, investigate the actions of any person alleged to have violated this section. If the commissioner or director determines that a violation has occurred, the penalty authorized by § 55-21-205 shall be assessed. Any person who is aggrieved by the assessment of the penalty may request a hearing that shall be held in accordance with the Uniform Administrative Procedures Act, compiled in title 4, chapter 5.Acts 1992, ch. 731, § 1.
