(a) Indictments or presentments under this chapter and chapter 5 of this title shall be only upon recommendation or request of the department of transportation, filed in the court having jurisdiction of the offense.(b) The department of transportation or any member thereof, or any person authorized by law to prosecute criminal cases, may be prosecutor.Acts 1897, ch. 10, § 26; Shan., § 3059a57; Code 1932, § 5433; T.C.A.
