Section 65-6-108 - Location of first of two lines

If, in determining any controversy over routes, it shall appear to the court that the second company, in good faith, intends to and probably will construct its road, the first line constructed shall be located, if practicable, so as not to make it unreasonably expensive to construct the other one.Acts 1899, ch. 399, § 1; Shan., § 1880a3; Code 1932, § 3148; T.C.A.
