Section 68-15-206 - Offenses - Penalties

(a) A person who knowingly omits or falsifies information required for inclusion on a tag required by this part commits a Class C misdemeanor punishable by a fine only. Each such deficient tag shall constitute a separate offense.(b) A person who knowingly includes misleading information on a tag required by this part commits a Class C misdemeanor punishable by a fine only. Each such deficient tag shall constitute a separate offense.(c) A person who knowingly sells in this state an article of bedding or item of filling material without the required tag or tags properly affixed to it commits a Class C misdemeanor punishable by a fine only. Each such omitted tag shall constitute a separate offense.(d) Notwithstanding any provision of this section to the contrary, a first offense for selling a secondhand mattress in violation of § 68-15-203(b) is a Class C misdemeanor, punishable by a fine only of fifty dollars ($50.00); a second offense is a Class B misdemeanor, punishable by a fine only of five hundred dollars ($500); and a third or subsequent offense is a Class A misdemeanor, punishable by a fine only of two thousand five hundred dollars ($2,500).
