(a) The state fire marshal may promulgate rules and regulations, pursuant to the Uniform Administrative Procedures Act, compiled in title 4, chapter 5, necessary to effectuate the purposes of this part.(b) The commissioner of revenue in the regular course of conducting inspections of wholesale dealers, agents and retail dealers, as authorized under title 67, chapter 4, part 10, may inspect the cigarettes to determine if the cigarettes are marked as required by § 68-102-505. If the cigarettes are not marked as required, the commissioner of revenue shall notify the state fire marshal. Acts 2008 , ch. 920, § 8.
