If the cost of the proposed improvement is to be raised by special assessment upon the lands to be benefited by the project, the court shall appoint three (3) commissioners who shall be disinterested financially in such proposed project.Acts 1955, ch. 112, § 23; T.C.A., § 70-1833; T.C.A. § 69-7-133.
