Section 7-86-104 - Creation - Referendum

(a) The legislative body of any municipality or county may, by ordinance or resolution, respectively, create an emergency communications district within all or part of the boundaries of such municipality or county. Prior to the establishment of such district, an election shall be held as provided in subsection (b).(b) The legislative body of any municipality or county shall, by resolution, request the county election commission to submit to the voters within the boundaries of a proposed emergency communications district the question of creating such district in an election to be held pursuant to § 2-3-204. In the election, the questions submitted to the qualified voters shall be, 'For the Emergency Communications District' or 'Against the Emergency Communications District.' The county election commission shall certify the results of the election to such legislative body. The expenses of such election shall be paid by such local government.Acts 1984, ch. 867, § 4; 1994, ch. 778, § 1.
