(a) In no event shall the person appointed as assistant secretary of state serve as such except during the existence of the emergency, and the governor shall determine when such emergency exists and when it terminates and shall so declare.(b) The action of the governor in declaring the existence of an emergency shall be subject to review by writ of certiorari.Acts 1949, ch. 120, §§ 1, 2; C.
